Terms of Service

1. Acceptance of Terms

By creating an account or using CreatorMail ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service Description

CreatorMail is an outreach research tool that aggregates publicly available information from YouTube and third-party data providers to surface contact information associated with YouTube channels. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

3. No Guarantee of Results

Email addresses, names, and other contact data returned by the Service are NOT guaranteed to be accurate, complete, current, deliverable, or owned by the identified person. The Service relies on public data sources, third-party APIs, and automated heuristics that may produce incorrect, outdated, or false-positive results. You are responsible for independently verifying any data before acting on it.

We make no representations regarding response rates, deliverability, reachability, business outcomes, or commercial viability of contacts surfaced by the Service.

4. User Responsibility & Compliance

You are solely responsible for how you use the data the Service provides. This includes compliance with all applicable laws, including but not limited to: CAN-SPAM Act, GDPR, CCPA, PECR, CASL, and any other anti-spam, privacy, or data protection laws in your jurisdiction or the jurisdiction of the people you contact. You must:

  • Honor opt-out and unsubscribe requests promptly.
  • Not engage in bulk unsolicited messaging that violates applicable law.
  • Maintain accurate sender identification and a valid postal address in messages where required.
  • Obtain consent where required by law.
  • Not use the Service for harassment, fraud, phishing, or any illegal activity.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall CreatorMail, its operators, owners, employees, contractors, or affiliates be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of (or inability to use) the Service — even if advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

6. Indemnification

You agree to defend, indemnify, and hold harmless CreatorMail and its operators from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including privacy or intellectual property rights; (d) any data or messages you send to third parties using contact information obtained through the Service.

7. Billing & Refunds

Subscriptions are billed monthly or annually via PayPal. All sales are final. We do not offer refunds for partial billing periods, unused credits, or change of mind. You may cancel at any time; access continues until the end of the paid period. Credit packs are one-time purchases and are non-refundable. PayPal processing fees are not refundable.

8. Acceptable Use

You may not (a) reverse engineer, scrape, or attempt to derive the source code of the Service; (b) use the Service to build a competing product; (c) abuse, harass, or threaten any individual whose contact information is surfaced by the Service; (d) resell, redistribute, or republish the Service's output to third parties as a dataset.

9. Account Termination

We may suspend or terminate your account, with or without notice, if we determine you have violated these Terms or for any other reason at our sole discretion.

10. Changes to Terms

We may revise these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the courts of New Delhi, India.
